This document sets out the terms and conditions governing the sale of products offered through www.beultraclub.com, owned by BE ULTRA SRL (also referred to below as “we”, “our”, “the seller” or “BeUltra”).

By using the website and purchasing our products, you fully accept these Terms and Conditions, together with our Privacy Policy and Returns and Refunds Policy. Should you disagree with any part of these terms, please do not use the website.

1. Purpose of the Agreement

This agreement governs the distance selling of goods through the beultraclub.com website, in accordance with Italian Legislative Decree No. 206/2005, the Consumer Code, and Italian Legislative Decree No. 70/2003 concerning electronic commerce.

2. Shipping

We ship throughout Italy and the European Union.

Estimated delivery times are 2–5 business days from the shipping date, except in the event of delays attributable to the courier. We use various logistics providers, including Poste Italiane, BRT and other reliable carriers.

Shipping costs vary depending on the market and destination. The applicable costs are clearly displayed at the time of purchase.

3. Prices and Payments

All prices are expressed in euros (€) and include VAT, unless otherwise stated.

We accept the following payment methods:

  • Credit or debit card, through Shopify Payments or Stripe

  • PayPal

Transactions are securely processed through the relevant payment platforms. We do not have access to your payment card details at any time.

4. Right of Withdrawal and Returns Policy

Pursuant to Article 52 et seq. of the Consumer Code, customers have the right to withdraw from the agreement within 14 days of receiving the product, without having to provide a reason, provided that the product:

  • Has not been opened or used

  • Is returned in its original, undamaged packaging

We do not charge any return handling fees. However, the shipping costs for returning the product are borne by the customer.

A refund will only be issued after the product has been inspected by our Quality Control Department. Should the product fail to meet the return requirements, for example because it has been used or damaged, the return will be rejected and the item may be shipped back to the customer at their expense.

5. Defective or Incorrect Products

Should the product received have a manufacturing defect or not match the product ordered, the customer is entitled to a replacement or refund pursuant to Articles 128–135 of the Consumer Code.

Customers must email support@beultraclub.com within 48 hours of delivery and include:

  • A description of the issue

  • Photographs showing the defect or incorrect product

6. User Accounts

Users may create a personal account to manage orders and personal information. Accounts are hosted on the Shopify platform.

Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.

7. Comments and Feedback

We accept voluntary reviews and feedback by email at support@beultraclub.com.

Some reviews or feedback may be published on the website, subject to our prior approval, without any obligation to provide compensation or a response.

8. Intellectual Property

All content available on beultraclub.com, including text, images, logos, trademarks and graphics, is either exclusively owned by BE ULTRA SRL or used under licence.

The unauthorised reproduction, distribution, modification, transmission or publication of any content is prohibited unless expressly authorised in writing.

9. Use of the Website

The website is accessible to all users.

The website must not be used for unlawful purposes, to infringe the rights of others or to transmit harmful software.

In the event of improper use, we reserve the right to suspend or terminate access to the service.

10. Limitation of Liability

The website is provided on an “as is” basis. We do not guarantee that its use will be free from errors or interruptions, or that the results obtained will always be accurate.

To the fullest extent permitted by law, we shall not be liable for any direct or indirect damage arising from the use of the website or the products purchased.

11. Governing Law and Jurisdiction

This agreement is governed by Italian law.

Any dispute concerning the interpretation or performance of these Terms and Conditions shall be subject to the exclusive jurisdiction of the Court of Florence, except where otherwise provided under the Consumer Code.

12. Amendments to These Terms

We reserve the right to amend these Terms at any time.

Any amendments will take effect from the date on which they are published on the website. Continued use of the website following the publication of any amendments constitutes acceptance of the revised Terms.
